These Terms & Conditions ("Terms") govern your access to and use of the sallyEmail service (the "Service") operated by Salemail ("Salemail", "we", "us", "our"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms.

1. The Service

sallyEmail is an AI email assistant that connects to Gmail and Microsoft Outlook via OAuth to summarize threads, draft and send replies, categorize messages, surface action items, and find leads on your behalf.

2. Your account

You must be at least the age of majority in your jurisdiction and, if using the Service on behalf of an organization, have authority to bind that organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date.

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for unlawful, fraudulent, deceptive, or spam-related activity;
  • infringe the intellectual property, privacy, or other rights of any person;
  • interfere with security features, probe, scan, scrape, or reverse engineer the Service;
  • upload malware or attempt to gain unauthorized access to any system;
  • use the Service to send unsolicited bulk email in violation of anti-spam laws.

4. Intellectual property

Salemail retains all right, title, and interest in and to the Service, including its software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service. You retain ownership of your own content (including email content processed on your behalf) and grant us a limited license to host and process that content solely to provide the Service.

5. Payments and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, cancellations, and refund mechanics are covered by Paddle's Buyer Terms, together with our Refund Policy and Pricing page.

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time through the customer portal linked from your account.

6. AI-generated output

The Service uses AI models to generate summaries, drafts, categorizations, and other outputs. You are responsible for reviewing outputs before sending, acting on them, or relying on them. AI outputs may be inaccurate, incomplete, or unsuitable for your purpose and are not a substitute for professional legal, financial, medical, or tax advice. You must have the rights necessary to submit any input you provide, and you must not use the Service to generate content that is illegal, hateful, deceptive, sexual involving minors, or otherwise abusive.

7. Service availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

8. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our policies or applicable law. You may stop using the Service at any time by cancelling your subscription and disconnecting your inboxes. Upon termination, provisions that by their nature should survive (including IP, disclaimers, and limitations of liability) will remain in effect.

9. Limitation of liability

To the fullest extent permitted by law, Salemail's aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. In no event will Salemail be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business. Nothing in these Terms excludes liability that cannot lawfully be excluded (such as for fraud, gross negligence, or death or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold Salemail harmless from any third-party claim arising from your use of the Service in breach of these Terms, your content, or your unlawful conduct.

11. Changes to the Service or these Terms

We may modify the Service and these Terms from time to time. Material changes will be communicated in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the seller's home jurisdiction, without regard to conflict-of-laws principles. Disputes will be resolved by the courts of that jurisdiction, unless mandatory local law provides otherwise.
